1. Acceptance of Terms
By downloading, installing, or using any application ("App") published by Phobic AS ("we", "us", or "our"), including "ataxophobic" and "DyrMatInfo", or by accessing our website at phobic.no, you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, please do not use our services.
2. Description of Services
Phobic AS develops and operates mobile applications available on iOS (Apple App Store) and Android (Google Play Store):
- ataxophobic: An inventory management application that allows users to photograph, organize, and track their belongings, including features for lending tracking, family sharing, and a recycle/sell marketplace.
- DyrMatInfo: A food price comparison application for Norwegian grocery stores that allows users to scan barcodes and compare prices.
3. User Accounts
Some features of our Apps require you to create an account. When you create an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us promptly of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. User Content
Our Apps allow you to create, upload, and store content including photographs, text descriptions, and other data ("User Content"). You retain ownership of your User Content. By using our services, you grant us a limited license to store, process, and display your User Content as necessary to provide and improve our services.
You are responsible for ensuring that your User Content does not:
- Violate any applicable law or regulation
- Infringe on the intellectual property rights of others
- Contain harmful, offensive, or inappropriate material
5. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the operation of our services
- Reverse engineer, decompile, or disassemble any part of our applications
- Use automated tools to scrape or collect data from our services
- Submit false or misleading price data (DyrMatInfo)
- Use our marketplace features to sell prohibited or illegal items (ataxophobic)
6. Intellectual Property
All intellectual property rights in our Apps, website, and services (excluding User Content) are owned by Phobic AS. This includes but is not limited to:
- Application design and user interface
- Source code and software
- Trademarks and logos
- Documentation and content
You may not copy, modify, distribute, or create derivative works based on our intellectual property without our prior written consent.
7. Pricing and Payments
Our Apps may offer free features and premium features available through in-app purchases or subscriptions. All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms and refund policies.
We reserve the right to change pricing at any time. Price changes will not affect existing subscriptions until their renewal date.
8. Family Sharing and Collaboration
The ataxophobic app includes features for sharing inventories with family members and household members. By using these features:
- You consent to sharing your inventory data with invited members
- You are responsible for managing who has access to your shared data
- Each member must have their own account and agree to these Terms
9. Community Data (DyrMatInfo)
DyrMatInfo relies on community-contributed price data. By submitting price data:
- You confirm the data is accurate to the best of your knowledge
- You grant us a perpetual, royalty-free license to use, aggregate, and display the submitted data
- You understand that submitted data becomes part of the community dataset
10. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Implied warranties of merchantability and fitness for a particular purpose
- Warranties that the services will be uninterrupted, error-free, or secure
- Accuracy of price data or community-contributed information (DyrMatInfo)
This does not affect your statutory rights under Norwegian consumer protection law.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Phobic AS shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of data, profits, or business opportunities
- Damages arising from your use of or inability to use our services
Our total liability for any claims arising from or related to these Terms or our services shall not exceed the amount you have paid us in the 12 months preceding the claim.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify and hold harmless Phobic AS from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your use of our services.
13. Termination
You may stop using our services and delete your account at any time. We may suspend or terminate your access to our services if you violate these Terms, subject to providing reasonable notice where possible.
Upon termination, your right to use our services ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through our applications or by email. Your continued use of our services after such notification constitutes acceptance of the updated Terms.
15. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of Norway. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Buvika, Norway.
For consumers resident in the European Economic Area, this does not affect your right to bring proceedings in your country of residence.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Phobic AS regarding your use of our services.
